Babachir Lawal, a former secretary to the government of the federation, and five other people have been cleared of the N544 million contract fraud charges filed against them by the Economic and Financial Crimes Commission by a Federal High Court in Abuja.

The anti-graft agency failed to build a prima facie case against the former SGF and the co-defendants, the court said on Friday.

Justice Charles Agbaza ruled on a no case motion submitted by Lawal and others, concluding that none of the 11 witnesses called by the EFCC established any element of any crime.

Additionally, according to Justice Agbaza, the EFCC neglected to connect Lawal with the Bureau of Public Procurement, which gave a certificate of no objection to the contract prior to its award.

Due to a lack of supporting evidence, the judge dismissed and cleared every defendant of the 10 criminal counts brought against them.

The EFCC brought charges against Babachir Lawal before Justice Agbaza, along with his younger brother Hamidu Lawal, Suleiman Abubakar, Apeh Monday, and two businesses, Rholavision Engineering Limited and Josmon Technologies Limited.

They faced 10 charges bordering on fraud, relating to the removal of evasive plant species to the tune of N544m, for which they pleaded not guilty.

The EFCC had on November 30, 2020 re-arraigned Lawal before Justice Agbaza.
